Important Notice Regarding Third-Party Financing

Cambria Dentistry PLLC, doing business as Diamond Arch™ (“Diamond Arch,” “the Practice,” “we,” “us,” or “our”) is pleased to provide information about third-party financing options that may be available to assist patients in paying for oral surgery, dental, and specialty services. Please read this disclosure in its entirety before applying for or utilizing any financing option. By applying for, accepting, or using any third-party financing in connection with services rendered at Diamond Arch, you (“the patient,” “you,” or “your”) acknowledge and agree to all terms set forth in this disclosure.

1. All Financing Is Provided Exclusively by Independent Third Parties

Diamond Arch does not provide, extend, offer, underwrite, originate, service, or administer any form of credit, loan, payment plan, or financing of any kind. Any and all financing arrangements referenced, displayed, linked to, or discussed on this website, in our office, or by any member of our staff are offered solely and exclusively by independent third-party financing companies, lenders, and financial institutions (“Third-Party Financing Companies”).

Diamond Arch:

  • Is not a lender, creditor, loan broker, loan originator, or financial institution;
  • Does not make credit decisions of any kind;
  • Does not set, control, negotiate, or influence interest rates, fees, promotional terms, repayment schedules, credit limits, or any other terms or conditions of any financing product;
  • Does not guarantee approval, eligibility, or the availability of any financing product;
  • Does not receive, hold, or manage your financing account, payments, or account information.

2. No Affiliation, Endorsement, or Agency Relationship

Diamond Arch has no ownership interest in, affiliation with, partnership with, joint venture with, or agency relationship with any Third-Party Financing Company. Any reference to, mention of, or link to a Third-Party Financing Company on this website or in our office is provided solely as a courtesy and convenience to our patients and does not constitute an endorsement, recommendation, guarantee, or warranty of any kind regarding that company, its products, its services, its practices, or its terms.

No employee, staff member, doctor, surgeon, or representative of Diamond Arch is authorized to act as an agent, representative, or broker of any Third-Party Financing Company, and no statement made by any member of our team shall be construed as financial advice, credit advice, a promise of approval, or a representation of financing terms. Any information our staff provides about financing options is general in nature and is not a substitute for the official terms, conditions, and disclosures provided directly by the Third-Party Financing Company.

3. Application, Approval, and Credit Checks

All financing is subject to application and approval directly through the Third-Party Financing Company. You understand and acknowledge that:

  • Applying for financing typically requires a credit check, credit inquiry, and/or credit report review, which may be a “hard inquiry” that can affect your credit score;
  • Approval is not guaranteed and is determined solely by the Third-Party Financing Company based on its own underwriting criteria, over which Diamond Arch has no control or influence;
  • The Third-Party Financing Company may approve you for an amount less than requested, decline your application entirely, or offer terms different from those advertised;
  • Diamond Arch has no access to, involvement in, or responsibility for the credit decision, and cannot appeal, reverse, modify, or explain any credit decision made by a Third-Party Financing Company;
  • Any denial of credit, reduction in credit limit, or impact to your credit score resulting from an application is a matter solely between you and the Third-Party Financing Company and/or the credit reporting agencies.

4. Your Responsibility to Review All Terms

Before applying for or accepting any financing, you are solely responsible for carefully reading, reviewing, and understanding all terms, conditions, agreements, and disclosures provided by the Third-Party Financing Company, including but not limited to:

  • Interest rates, including annual percentage rates (APR), whether fixed or variable;
  • Deferred interest and promotional financing provisions, including the consequences of failing to pay the full balance before the end of a promotional period (which may result in retroactive interest charges on the entire original balance);
  • Minimum monthly payments and repayment schedules;
  • Late fees, penalty fees, penalty interest rates, returned payment fees, annual fees, and any other charges;
  • Default provisions and consequences of missed or late payments, including collections activity and credit reporting;
  • Prepayment terms, cancellation terms, and refund handling procedures;
  • Arbitration clauses, dispute resolution procedures, and governing law provisions;
  • Privacy policies and how your personal and financial information will be used and shared.

By proceeding with any financing, you acknowledge that you have had the opportunity to review all such terms, that you accept full and sole responsibility for understanding them, and that you did not rely on any statement, summary, or representation made by Diamond Arch or its staff in deciding to apply for or accept financing.

5. Assumption of Financial Responsibility

You understand and agree that:

  • All financial obligations arising from any financing arrangement are solely between you and the Third-Party Financing Company. Diamond Arch is not a party to your financing agreement and bears no responsibility for it;
  • You remain fully and personally responsible for all amounts owed for services rendered by Diamond Arch, regardless of whether financing is approved, denied, delayed, reduced, revoked, cancelled, or disputed;
  • If a Third-Party Financing Company declines to fund, reverses funding, charges back a payment, or otherwise fails to remit payment for any reason, you remain directly liable to Diamond Arch for the full balance of all services rendered;
  • Diamond Arch is not responsible for any interest, fees, penalties, collection costs, credit damage, or any other financial consequence, loss, or outcome arising from your use of, application for, or default under any third-party financing product.

6. Insurance and Elective Use of Financing

Diamond Arch is an oral surgery and dental specialty practice. Some patients may have dental insurance, medical insurance, or other third-party coverage that may or may not apply to services rendered at our office. You acknowledge and agree that:

  • The decision to use third-party financing instead of, in addition to, or in combination with insurance benefits is solely your own voluntary and elective decision;
  • If you have insurance coverage (in-network or out-of-network) but choose to receive treatment at Diamond Arch and pay privately, through financing, or otherwise outside of your insurance plan, you do so knowingly, voluntarily, and at your own election, and Diamond Arch bears no responsibility for any benefits you may forgo, any difference in out-of-pocket cost, or any consequence of that decision;
  • Estimates of insurance coverage, benefits, or reimbursement provided by our office are estimates only and are not guarantees; your insurance carrier makes all final benefit determinations;
  • Diamond Arch is not responsible for insurance denials, delays, downgrades, reductions, or non-payment, and any amounts not covered by insurance remain your responsibility, whether paid directly or through third-party financing;
  • Using financing does not alter, waive, or reduce your financial responsibility for services rendered, and any refund, reimbursement, or coordination between your insurance carrier and a Third-Party Financing Company is your responsibility to pursue and resolve.

7. No Financial, Legal, or Credit Advice

Nothing on this website or communicated by Diamond Arch or its staff constitutes financial, legal, tax, or credit advice. We strongly encourage you to consult with a qualified financial advisor, and to contact the Third-Party Financing Company directly with any questions about its products, before applying. Rates, terms, promotional offers, and product availability are set by the Third-Party Financing Companies, may change at any time without notice to Diamond Arch, and any information appearing on this website may be outdated. The official application materials and agreements provided by the Third-Party Financing Company control in all cases.

8. Treatment Decisions Are Independent of Financing

Decisions regarding your diagnosis, treatment plan, and clinical care are made based on your health needs and professional clinical judgment, independent of any financing arrangement. The availability or unavailability of financing does not obligate Diamond Arch to render treatment, and payment arrangements must be resolved in accordance with our office financial policies before or as treatment is provided, as applicable.

9. Disclaimer of Liability

To the fullest extent permitted by law, Diamond Arch, its owners, doctors, surgeons, employees, agents, and affiliates disclaim any and all liability, responsibility, and obligation arising out of or related to:

  • Your application for, approval or denial of, use of, or default under any third-party financing product;
  • Any act, omission, error, misrepresentation, term, fee, rate, practice, data breach, or conduct of any Third-Party Financing Company;
  • Any impact to your credit score, credit report, or creditworthiness;
  • Any dispute between you and any Third-Party Financing Company, credit bureau, or collection agency;
  • Any financial loss, cost, fee, interest, penalty, or other outcome or consequence of any kind arising from your financing decisions.

Any claim, dispute, or issue relating to a financing product must be directed solely to the applicable Third-Party Financing Company.

10. Acknowledgment

By applying for or using any third-party financing in connection with services at Diamond Arch, and/or by signing our office financial policy and consent forms, you acknowledge that:

  1. You have read and understand this Financing Disclosure in its entirety;
  2. You understand that all financing is provided by independent third parties, requires an application and credit check, and is subject to approval;
  3. You understand that Diamond Arch has no affiliation with, and assumes no responsibility for, any Third-Party Financing Company or its products;
  4. You accept sole responsibility for reviewing and understanding all financing terms, rates, fees, and conditions, and for all financial obligations and outcomes arising from your financing decisions;
  5. You remain fully responsible to Diamond Arch for payment of all services rendered, regardless of financing or insurance outcomes;
  6. Your choice to use private payment or financing, including instead of available insurance benefits, is voluntary and made at your own election.

This disclosure does not modify or replace any separate financial policy, consent form, or agreement you sign with Diamond Arch, which remain in full force and effect. If any provision of this disclosure is found unenforceable, the remaining provisions shall continue in full force.
